未來法律形成與電子化政府的發展需要重視典範的移轉。本文檢視Jean Cohen教授所提出的一項典範移轉,並用於批判一項著作權的立法-數位千禧年著作權法。數位著作權保護的課題確實十分具有爭議性,該議題的研究,亦涉及法學,社會,政治,經濟,以及文化面向等科際整合上的難題,這項特質,使得傳統法律形成的模式,在數位著作權課題上,面臨困境。所需要的新思維,必須更加重視對話,以及國家立法與自我規制之間合作的關係。

Future approach toward law making as well as e-government are in need of paradigm shift. This paper examines one of such new legal paradigm advocated by Jean Cohen and illustrates why it deserves our consideration through testing on a digital copyright legislation-Digital Millennium Copyright Act (DMCA). Digital copyright protection issues are extremely controversial, and are highly interdisciplinary as they relate to both traditional legal scholarship and modern social political, economic and cultural dilemmas. Such a characteristic explains why the traditional law making approach is facing difficulty and why an approach that emphasizes more on dialogue and the cooperative relationship between government and self-regulatory efforts is essential in the future.
