中國傳統的公私之辨,因「公」「私」概念的所指不一,而所涉及的問題和內涵亦不等。就其核心本質而言,公私之辨涉及國、民、群、己的關係。儒家秉持「天下為公」的理念,認為天下國家非君主一人一姓之私產。為此,君主行政應該公正無私,這不僅需要培養君主的德性,而且更應該通過制度來擔保政治的公平正義。儒家主張合私成公,「公」的實質就是個體私權的普遍實現。闡明儒家的這些基本理念,有助於澄清人們對儒家一些習以為常的誤解。 |
英文摘要 |
The distinction between public and private in Chinese traditional thoughts involves some different themes and connotations due to the different meanings of the terms of "public" (gong/公) and "private" (si/私). As far as the core notion concerned, it refers to the relationship between the state and the people, between community and individual. Confucianism holds an idea named "the world belongs to all the people" (tian xia wei gong/天下為公), and thinks that the world and the state aren't the private property of sovereign. Therefore, the sovereign's rule should be according to the principle of justice. This needs not only the sovereign's virtue of impartiality, but also establishing some institution. Confucianism insists that the essential conception of Public(gong/公) lies in realizing every individuals basic interests and their basic private rights universally and sufficiently. Since the traditional monarchy hampered these ideas to be realized, then democracy and rule of law are inner requirements of Confucian idea of public and private. |
