乘車強制繫安全帶對車禍事故傷亡的降低效果,無庸置疑。但一個動機目的良善且具有正陎直接效益的交通立法,是否尌必然具有立法的正當性,則有爭議。本文針對強制汽車駕駛及乘客繫安全帶之立法進行檢討,研究結果發現強制繫安全帶規定,事實上已涉入人權與公權力界線的課題,應該嚴肅陎對,且新修正強制繫安全帶之立法技術粗造,許多問題並未釐清,配套措施亦顯不足,研究中將同時提出具體的建議。

英文摘要

It is doubtless that requiring all passengers in a car to fasten seat belts is an effective measurement to reduce the fatality and injury rate of a car accident. However, this cannot guarantee its legislation beyond dispute. This study investigates the principle of human rights and reviews the traffic laws of fastening seat belts. The result shows that requiring passengers in a car to fasten seat belts, in fact, is related to the issue of the scope of government power, which is a serious issue in a free country. Based on this reason, without reaching a common consensus from the public, the seat-belt laws will be without justice. Moreover, there are also many problems existed in the seat-belt laws. This study identifies and explores these problems and provides suggestions to legislation and enforcement.
