從美國沃客爾規則看銀行業務之管理

美國2010年通過道德法蘭克華爾街改革以及消費者保護法，其中最具爭議條文之一，即為法克爾規則，決克爾規則主要禁止銀行業從事自營交易，以及投贊避險基金或私募股權基金，避免利益衝突，以防止費用高昂的金援，保障存款人之權益，降低納稅人之潛在損失，以及對金融市場的威脅，惟涉及產業利益，迄今受到很大的質疑。因此，本文擬從比較法之觀點，瞭解決克爾規則訂定之立法背景與目的，分析其規範之內容與相關爭議，並與國內法進行分析比較，並探討銀行業務管理法制的問題，最後則提出本文之結論與建議。
