澳洲建國歷史雖短，但法制於英美等國之間，斟酌損益，斐然可觀，饒有特色，且有所長。雖係英美法系，在立法、司法與比較法研究各方面，可供吾人參考之處不少。況際茲國人移民日益眾多，往來更繁之今日，更有瞭解其法制與實際運作之必要與價值，惜國內有系統通盤分析介紹澳洲法制之文獻極其欠缺，去歲爰乘暑假留澳二月之便，至各圖書館查閱書籍，努力整理撰成此文，以饗國人。
