本文乃以討論違反公平交易法行為之私法效力，從競爭法及民法角度探討為主要內容。 在民法上被認定為無效之行為，對於交易關係將有重大之影響。而違反規範事業間事業活動之公平法，其攸關各項交易行為，因此違法行為在私法效力上認定無效，必須十分謹慎。 對於違反公平法行為之私法效力，是否認定其無效必須視個案而定之。所考量之因素，包含公平法規範該行為之目的、該違法行為之違法程度、尤其是對於市場競爭秩序之傷害。此外，確保交易安全以及保障交易中第三人之利益亦是同屬重要。 希望籍由本文之探討，能串聯公平法與民事法之交集。

This paper investigates the validity of the conduct which violates the Fair Trade Act under an essay on viewpoints of competition policy and civil laws. Under the Civil Code, a conduct is deemed void that has a serious effect on a transaction. For the reason, courts are very cautious in holding that unlawful conduct is void. Whether conduct which violates the Fair Trade Act, should be deemed void or not is determined on the case-by-case basis, taking into account factors such as the purposes of the prohibitions on the conduct, the degree of illegality of the conduct, to what extent the conduct harms the competition in the market. In addition, the needs for ensuring safe trade, and needs for protections of the third party that is involved in the transaction are important, too. It is hoped that the study would contribute to our understanding of the relationship between the Fair Trade Act and civil laws.
