台灣治理通姦行為，從入罪到除罪的更迭，反映觀念轉折與否，恆常緊繫既存制度前景的變動；是要保持既有觀念不變，存續制度經驗慣行，或是改變既有觀念，廢止制度現況。有無觀念轉折與既有制度存廢兩者之間，究竟存在什麼共同的制度性動因，能在敏感依附初始情境的存廢爭議中，讓通姦罪轉化為通姦除罪，促使路徑依循生成關鍵時刻。讓我國前後二次的通姦罪釋憲案，出現新號違憲見解背反舊號合憲見解。面對台灣通姦罪由存轉廢的變動，似乎已超出新制度論學理視野中，現狀不變、深化或演化的變遷類型。因此。盼從新制度論學理基礎，在不涉通姦罪存廢有無對錯的前提之下，嘗試以論述制度論加上權力觀點的整合理論途徑，就觀念轉折的動因與既有制度的作用，進行形式的分析，提出權力論述的概念性架構，回答台灣通姦罪為何出現，從有到無的制度變動。

Taiwan's policy changes in the governmentality of adultery, from criminalization turning on decriminalization, reflecting the change in the foreground of the existing institution, which is always closely related to the ideational turn; whether it is ideation remained stable and unchanged, the experience of existing institution to custom action, or to change the existing ideational ,the current status of the abolition institution. Between the existence or non-existence of ideational turn and the existence or abolition of existing institutions, what are the common institutional forces being? In Policy Controversies with sensitive dependence on initial conditions, practice decriminalizes adultery, prompting path dependence supporting the emergence of critical juncture. Taiwan's Constitutional Court Interpretation No.791 rules criminalizing adultery unconstitutional, which contradicts the No.554 constitution in the past, and did not lead to a confrontation with political violence. In the face of the change from existence to abolition of adultery in Taiwan, it seems to have gone beyond the New Institutionalism's view, the type of institutional change: status quo remained unchanged, deepening and evolution. Attempt to propose an integration approaches of discursive institutionalism and power perspective. Based on the theory of Institutionalism, the institutional forces of the ideal turn and the existing institutional roles, carry out a formal practical logical analysis, and use the Discourse of Power institutionalism framework.
