憲法象徵一個國家的最高規範,倘若國家的最高規範必須經由其他國家的認可與批准程序,實不符合民主的基本邏輯,1982年以前的加拿大即是此例。本文從憲政民主應立基於憲政本土化的觀點出發,並以加拿大的憲法變遷作個案分析,探討憲法本土化的變遷過程,以及憲法變遷如何深化憲政民主。

英文摘要

As the supreme regulation, it does not conform to the value of democracy that constitution must be approved by other countries, such as Canada before 1982. This article considers that constitutional democracy should be base on the patriation of constitution and looks into the experience of constitution change in Canada.
