On the Phenomenon of Fragmentation in International Law: The Case of the Amendments on the Crime of Aggression to the Rome Statute

2010年坎帕拉會議完成《羅馬規約》對侵略罪定義與管轄方式的修訂，但侵略罪的管轄方式卻與《羅馬規約》發生矛盾、不一致，直到2018年國際刑事法院即將正式啟動對侵略罪的管轄權，問題仍舊懸而未決。本文將先對國際法上的碎片化進行介紹，再解析有關侵略罪修正案的管轄權問題背後成因與各方立場，最後再以國際法上碎片化的觀點進行來回應。

In 2010, the Kampala Conference completed the amendments of the Rome Statute on the definition of crime of aggression and the mode of jurisdiction. However, the pattern of jurisdiction over the crime of aggression is inconsistent with the Rome Statute until the International Criminal Court is about to formally initiate the jurisdiction on the crime of aggression in 2018, although the issue is always pending. This thesis will first introduce the fragmentation of international law, then analyze the causes behind the issue of jurisdiction over the amendment to the crime of aggression along with the positions of all parties, finally through the view of fragmentation in international law to respond to it.
