本研究比較台灣與中國大陸主要水土保持相關法規，包括「水土保持法」、「水土保持施行細則」及「水土保持技術規範」，發現兩岸「水土保持法」雖然章節編排相似，但內容則因國情不同而有差異；「水土保持法施行細則」內容均為解釋水土保持法；台灣以「中華民國水土保持技術規範」，而中國大陸以「水土保持綜合治理」為設計依據；並以山坡地開發觀點，進一步深入比較兩岸於水土保持規劃設計上，引用公式及重現期距之差異性，發現兩岸相關技術規範有相當大差異，因此進行大陸之水土保持規畫設計時，需要充分了解大陸法規，以免造成設計錯誤。

This study compared the related regulations of soil and water conservation between Taiwan and Main Land China. These laws include Soil and Water Conservation Act (SWCA), Enforcement Rules of Soil and Water Conservation Act (ERSWCA), and Soil and Water Conservation Technical Specifications (SWCTS). After the Comparison between both sides, we found the following conclusions: (1) The chapter layouts of SWCA between both sides are similar, but the contents are unlike due to the different national conditions; (2) ERSWCA is used to explain SWCA; (3) Taiwan adopted SWCTS of Republic of Chain to process the soil and water conservation design, and the Main land China used ”Planning for Comprehensive control of Soil Erosion”, respectively. This study also compared the differences of equations and return periods for soil and water conservation between both sides in the stage of planning and design, and found that the technical specifications have considerable differences between both sides. Therefore, when we process the soil and water conservation design, the fully understand of the laws and regulations in the mainland China are necessary in order to avoid design errors.
