本文針對目前全國大學院校兼任助理納保之爭議事件,提出省思和論述。作者呼籲,欲釐清問題本源,須回到獎助學金制度上探討,並透過對助學金制度及學生在校工作權益,進行通盤的理解和討論,才能對症下藥,找出解決之道。作者針對兼任助理納保之判定,牽涉到牴觸現行大學法、法規解釋標準不一、不符合僱傭關係及違反憲法保障大學自治原則等議題層面,提出制度法規面之分析與討論,並在 實務執行面提出四點建議:建議暫停執行兩原則,進行必要之修法工程;學生在校 工讀╱工作權益之處理應回歸為教育主管機關;盡速完善學生在校工讀╱工作之保障;以及盡速修訂大學獎助學金制度規範。 |
英文摘要 |
The purpose of paper aims at the controversy of compulsory labor insurance requirement for on-campus part-time working student assistants. The author claims that there is a misunderstanding to the university scholarships and financial aid policy, which needs a thorough comprehensions and discussions in order to clarify the controversy and to solve the problem out. The author addresses the controversial verdict to the petition of students' on-campus work rights that might be involved in, not only contradicting with the University Act and the Constitution, but also misleading the relationship between on-campus working students and university resulted in a chaos of the current matter. The author urges to suspend two principles of management for students' on-campus work rights declared by the Ministry of Labor and Ministry of Education in order for the amendments of the existed contradictory regulations against each other. It has to be ensured that the administrations of on-campus work rights protection belong to the authority of the Ministry of Education. The author suggested that the coverage of on-campus work rights protection as well as new regulations for university scholarships and financial aid policy had better to be improved by the Ministry of Education. |
