所謂「虛擬轉蛋」,係一種依遊戲業者事先設定之參數,自多種虛擬寶物中,亂數取得虛擬寶物之新型商業模式。消費者無法於事前決定取得內容,於轉蛋後始可得知;遊戲業者僅保障消費者至少可取得一種虛擬寶物,至於取得的種類,則非其保障範圍。關於虛擬轉蛋之法律定位,國內目前眾說紛紜,雖然行政院2018年10年公布之「網路連線遊戲服務定型化契約應記載及不得記載事項」中,稱虛擬寶物為「機會中獎商品」,與傳統通說認為轉蛋所得物係贈品之看法,有所不同。在法律適用上,究以何者之論點較為可採,不無疑問。本文擬就上述兩說,再加上國外之見解,綜合討論,並於文末提出本文之看法。 |

Loot box is a way to get virtual items in game. Consumers get one of virtual item from several different kinds with a randomized selection which is set by game provider in advance. In loot boxes, consumers cannot choose to get which one and game provider only have to promise consumers can get one of virtual items. As for kinds of virtual items which consumers get, is nothing to do with game provider. In Oct. 2018, the competent authority released "Internet Game Services' Standard Contracts Must Write-in and Should Not Write-in Things" and use "winning goods by opportunity" to define virtual items which are get by loot boxes. It seems that the competent authority is different to traditional opinion of the judgements, considers the legal position of virtual items are goods rather than gifts of the trade of loot boxes. This research will compare the opinion of the competent authority and the judgements besides foreign rules, discuss which the legal position of loot boxes is. |
