民間參與都市更新面臨問題之探討

都市更新的內涵，乃是將頹敗地區重新賦予一個新生命，關於都市更新的議題，亦為世界各都市發展所需面臨之問題。目前由以民間擔任都市更新實施主體，並以重建方式辦理都市更新。本文目的主要以民間辦理都市更新問題為研究主題。本文首先回顧都市更新之歷史沿革，並檢討現行民間都市更新案件於執行過程中所面臨的問題。民間辦理更新過程中可能面臨的主要問題包括：相關法規的配合、審議機制與獎勵補助機制之健全、及對原住戶的拆遷安置措施完善與否等問題。

The essence of urban regeneration is to breathe life afresh into the slums and ghettos of the city, a subject on which the world’s leading city developments have yet to reach a consensus. Presently, private departments are the main performers of urban regeneration who conduct the urban regeneration by the way of renewal. This study reviews the history that the urban regeneration and then explores and analyzes the problems and bottlenecks encountered. In the process of renovation conducted by private departments, the problems that they may encounter include the following: observance with related statutes, good deliberation mechanism and the rewarding and subsidizing mechanism, and the thoroughness of the settlement measures taken for demolition and renovation.
