海峽兩岸的漁業合作－漁業管理水域之劃定、對外漁業關係之建置及漁船船員之僱用

本文係從法的角度來探討海峽兩岸在漁業方面合作的可行性。主要就三個問題為討論：海峽兩岸在中國漁業管轄海域中的管理合作、海峽兩岸在對外漁業關係方面的合作、海峽兩岸漁船船員勞務合作制度。此外，對於海峽兩岸漁船船員勞務合作制度中，臺灣所制定「臺灣地區漁船船主境外僱用及接駁暫置大陸地區漁船船員許可及管理辦法」的合法性問題也為進一步討論。海峽兩岸漁業合作的涵蓋面甚廣，本文僅就前揭問題為探討對象，並提出可行的方案。

The objective of this essay is to study the possibilities of cross-strait fisheries cooperation with respect to delimitation of fisheries management zones, establishment of international fisheries relation and employment of crew member of fishing boats. In addition, the legality of ＂Regulations on the Permission and Administration of Taiwanese Fishing Boat Owners Offshore Employment, Transit and Temporary Settlement of Crew Members from Mainland China＂ will be discussed as well. The cross-strait fisheries cooperation covers a broad variety of dimensions but this essay will only focus on the subjects mentioned above.
