近來討論戰後運臺文物之產權歸屬已成紛紜,有從文化面切入,而提出人地聯繫說、族裔淵源說、世界遺產說、保存能力說,以及管理付出說等分析;亦有從法律面切入,提出國家繼承說、政府繼承說、政府承認說、時效取得說,以及現行法制說等析論。綜觀此般說法及論斷皆有其理,但卻缺乏歷史法制與史實溯源的考量。因此,本文透過國立歷史博物館所藏甲骨的產權此一個案,從其考古出土脈絡及當年的國家法制規範等兩軸分別探討,以辨明戰後運臺古物之產權爭議,進而釐清運臺考古出土物之產權歸屬,期待對日後運臺文物的相關問題,有正面積極的意義及價值。 |
英文摘要 |
Many debates about the ownership of antiquities that were transported to Taiwan after World War II have taken place recently. Some argue from a cultural perspective that antiquities must connect with people and nations, and support their views based on analyses of ethnicity, world heritage, preservation capability and even management. Others argue from a legal perspective, such as national legacy, governmental legacy, recognition of government, validity of acquisition and current legislation. Each argument has its grounds and rationality, but lacks consideration of historical legislation and historical origins. In this paper, the author presents a case study to examine the historical context of unearthed oracle bones, as well as national legislation and regulations that were in place at the time. The author first provides an overview of the context of arguments that have been raised, identifying issues concerning the ownership of unearthed antiquities. The results of this study may prove useful and valuable for clarifying the ownership issues of antiquities that were shipped to Taiwan after World War II. |
