臺北市立美術館依《臺北市立美術館聘任人員年度考核要點》將2位助理研究員(官等薦任)及1位解說員(官等委任至薦任),以連續2年考績乙等及丙等為由不續聘;查該人員依《教育人員任用條例》聘任,分別長達23年、18年、17年,已屆退休之齡,無任何不法情事;然,再申訴與訴訟至公務人員保障委員會及行政法院,皆被駁回,喪失工作權。而近來行政院所擬定《聘任人員人事條例草案》將專業人員移入,賦予機關自訂考核內容之行政規則,進而得解聘、不續聘人員,若條文通過,將會有更多北美館案例出現,可預見社教機構專業人員將全然崩解;本文以此案例為軸,關注現下專業人員所面臨之任職危機。 |

Based on the "Annual Contract-Based Employee Performance Review Guidelines of the Taipei Fine Arts Museum", the Taipei Fine Arts Museum did not renew the contracts of two assistant curators (civil service junior rank) and one interpreter (civil service elementary to junior rank), with B-class and C-class performance ratings for two consecutive years. The reviewed employees were hired under the Act of Governing the Appointment of Educators and had 23 years, 18 years and 17 years of seniority, respectively. All had reached retirement age. None had been accused of malpractice. They appealed this decision to the Civil Servants Protection and Training Commission and filed a lawsuit in administrative court. Neither ruling was in their favor and they lost their positions. Moreover, the Executive Yuan has recently formulated Draft Regulations for Contract-Based Employees, which also cover professionals. These grant organizations the authority to determine the content of performance review administrative rules, including the dismissal of employees and non-renewal of employee contracts. If passed, it is expected that there will be more cases similar to that of the Taipei Fine Arts Museum and complete demoralization of social education organization professionals. The aim of this paper is to discuss the job insecurity faced by such professionals, with focus on the case of the Taipei Fine Arts Museum. |
