談博物館蒐藏礦物原石可能遭遇的法律議題－以所有權為核心

過往研究討論博物館蒐藏之礦物，多重視文物保存相關議題，如室內空氣品質或溫溼度之影響。如有提及礦物展相關，也是討論觀眾行為，較少討論法律議題。又如我國《博物館法》規定或ICOM《博物館職業倫理準則》，除本於專業倫理執行業務，確認合法性亦係博物館管理重點之一。經本文研究發現，無論是採購、捐（受）贈、採（徵）集或交換，討論蒐藏礦物原石之法律議題，特別是《民法》之所有權，尚涉《文化資產保存法》、《礦業法》或《國家公園法》等，因此擬透過原石為豐田玉、北投石及隕石3類個案，協助瞭解相關法令內容。本文建議，如為降低法律風險，博物館管理者或從業人員可於內部流程，明定確認礦物原石所有權之流程與所需佐證文件，含契約約定或出示公函等。

Past research on mineral collections has mostly focused on preservation of specimens or visitor behavior in mineral exhibitions, rather than on legal issues. According to the International Council of Museums (ICOM) Code of Ethics for Museums and the Museum Act in Taiwan, legal issues are among the most common issues in museum management. In this study, legal issues related to the acquisition of mineral specimens were analyzed based on three case studies of nephrite, hokutolite, and meteorite specimens, respectively. It was found that regulations with particular focus on the ownership of mineral collections are included in the Mining Act, National Park Law, and Cultural Heritage Preservation Act. Finally, it is suggested that all public and private museums in Taiwan add certain requirements, such as confirmation of contract and ownership, to their standard operating procedures (SOPs) or internal regulations for the purchase or acceptance of donations of mineral specimens.
