本文旨在探討離異父母於嚴重特殊傳染性肺炎(COVID-19)的三級警戒期間之子女會面紛爭,藉由調查此期間之離異父母於子女會面的困境及就實務面提供相關建議,作為實務工作推行之參考。本文收集127位離異父母的調查問卷,調查發現:一、有八成的填答者於三級警戒期間的子女會面的溝通與進行受到影響,二、同住方與探視方於疫情期間之子女會面所產的主要情緒皆為擔心、但原因不同,探視方的擔心來自於疫情的不確定性而不知何時可以恢復探視、擔憂對方以疫情為藉口阻撓會面、擔憂暫緩卻無替代方案而使親子關係疏離,同住方的擔心來自於不信任對方之防疫措施、擔憂兒少染疫、擔憂片面拒絕進行會面的後果。三、求助管道以司法相關單位與人員為主。本文就實務上提供的建議為一、持續推廣社區家事商談服務,使相關單位與大眾認識在地資源。二、政府相關單位網站公告相關指引資訊及協助資源。三、公眾教育則仍需持續倡議兒童權利公約之親子關係維繫權。 |
英文摘要 |
The purpose of this paper is to examine the visitation disputes between divorced parents during the epidemic level three alert of the COVID-19 with the aim to understand the dilemma of divorced parents and provide relevant suggestions for future practice. Through a simple questionnaire, the visitation experiences of 127 divorced parents. The survey finds are as follows: 1. 80% of respondents' visitation was affected during the epidemic of the COVID-19. 2. The main emotions of the divorced parents due to visitation during the epidemic of the COVID-19 are worries, but the reasons are different. The Noncustodial parents worry comes from the uncertainty of the epidemic and does not know when they can resume visiting, and they are worried that the other party uses this pandemic as an excuse to refuse the visitation, the parent-child relationship will be alienated and may require to temporary change but there is no alternative. The party worry the other party's parenting skills and therefore more risk for children, and worrying about the legal consequences of refusing to visitation. 3. Lack of resources for help and related information. The recommendations are: 1. Social welfare agencies of providing family mediation to assist divorced parents negotiation of their children's care during the epidemic of the COVID-19. 2. Government agencies provide guidance and assistance resources on their websites. 3. Public education needs to advocate the rights of child visitation in the Convention on the Rights of the Child. |
