檔案開放應用是「檔案法」立法目標之一，同樣也是政府資訊開放政策的一大實踐。「行政程序法」第一章第七節相關規定，明白確立了政府資訊公開制度的方向，「檔案法」第三章則進一？規劃出檔案開放應用之具體作法，為建構政府資訊開放制度開啟了新頁，將原即屬於資訊範圍的標的正式推向表演的舞台。在施政公開化、透明化及滿足民眾知的權利的要求下，檔案開放與政府資訊公開無論是立法基礎、實踐內容或條件限制等，皆有或多或少的交集，此類交集與競合，存有相輔相成併行不悖之關係，原是肆應資訊公開、建構法律環境的最低要求。本文擬自現行法令規定，分析檔案開放與資訊公開之競合關係，藉此俾益於各該法令之適用與執行。

The availability to access government information is one of the legislation goals toward the Archives Act. Meanwhile it's the big step for government to implement the information freedom strategy. The section seven, chapter one of the Administration Procedure Law firmly regulates the direction of government information freedom system. The 3rd chapter of Archive Act further schemes the actions plans for practice. The two laws have established the new page for government's information freedom system and promoted our object to the real performance stage. Under the demands of open/transparent administration and people's satisfaction toward the rights of knowing, the accessibility of government archive and the publication of government information are more or less similar at following parts°Gthe base of legislation°Athe practicing actions plan°Athe strains or conditions. This sort of simulation or prevalence between the Archives Act and the Administration Procedure Law may exist in parallel and enhance the application efficiency of the two laws. This connection is the minimum requirement to set up the information freedom system or structure a legal environment. The article will stand on present regulations to analyze the connection between archive accessibility and information freedom. Hopefully it will help to understand the application and execution of the Archives Act and the Administrative Procedure Law.
