本文首先探討了國際法院的邊界區域案對於環境影響評估的新發展。其次比較了兩位法官Donoghue與Dugard的協同意見書與爭辯。本文認為,國際法院或相關法庭在環境影響評估發展的角色應該已經到達極限。

英文摘要

This paper firstly discuss the latest development with regard to the law of environmental impact assessment in the joined cases of Certain Activities Carried Out by Nicaragua in the Border Area (Costa Rica v. Nicaragua)/Construction of a Road in Costa Rica along the San Juan River (Nicaragua v. Costa Rica). Secondly, it compares the debate between Judge Donoghue and Judge ad hoc Dugard's separate opinions. Finally, it argues that the role of international courts and tribunals in the development of environmental impact assessment should have reached its limit.
