When gender discrimination is caused by traditional culture or gender stereotype in society, it's hard to decide that gender equality or traditional culture should be priority. In 2015, Taiwan's Constitutional Court (Judicial Yuan) and the Supreme Court of Japan both had the cases which were about the conflict between gender equality and traditional culture. Because of the words used in the laws are quite objective in form, but gender discriminations are caused by the laws essentially. The laws are all about the core of marriage and family system which are constructed by family name, property and worship ancestor in particular. These disputes are the Statutes Governing Ancestor Worship Guilds stipulates in Taiwan, and Japan Civil law that enforce married couple who must use the same family name. In my observations, I think the courts ignored the facts of indirect discrimination in gender when taking balance between gender equality and traditional culture. Therefore, they neglected the importance of CEDAW and only took rational standard judicial review. As a result, Taiwan and Japan lost opportunity to practice gender equality and improve the traditional culture.
