隨著中國大陸公共體育服務體系的構建和完善，針對幼兒、青少年、老年人、殘障人等不同人群的體育學術理論探討已經進入學術界的視野。中國自古以來幼兒體育實踐活動精彩紛呈，但概念的提出和理論的探討相對較晚。本研究將就幼兒體育權利來源、幼兒體育權利內容、幼兒體育權利的法律構成以及幼兒體育權利的性質等有關幼兒體育權利的理論問題的梳理和討論。文章認為，幼兒體育權利主要由體育受教育權和體育遊戲權兩類權利構成。在法律性質上，幼兒體育權利首先從屬於教育權，其次在中國大陸仍是一種推定權利。

With the construction and improvement of public sports service system in Chinese, academic study for sports of young children, adolescents, the elderly, people with disabilities and other different groups has entered into the academic field. Since ancient times the Chinese children's sports activities are very diverse and the concept and theoretical research of early childhood education is late. This study will discuss the origin, content, legal nature, constitution of preschool physical right and the other theoretical problems. The article thinks, early children's sports right is divided into physical education right and the right of sports games. In legal nature, early children's sports right belongs to the right to education is still a presumption of rights in China.
