1、大學乃學術中心、傳授知識並做深入之研究,有知識、道德與應用能力之目的而加以設置之機構。所以大學的成果,有某種程度應向社會做公開的發表。2、大學中除屬於不正競爭防止法中之營業秘密外,還包括許多資訊,例如未發表論文、著作、提出專利申請前之文件、入學考試試題、學生成績等個人資訊,原則上都應進行秘密管理。也就是說大學營業秘密之管理,是其資訊適切管理之一部分。3、一般而言,營業秘密管理的目的乃基於以下兩點(1)保護自己的財產;(2)禁止他人侵害自己的營業秘密。 |
英文摘要 |
1. University is the academic center, to impart knowledge and do in-depth studies. It also has a moral purpose to teach. Therefore, a goal of the university should be publishing its research for society.2. Trade secret management for university also includes much personal information, for example, unpublished papers, books, files before a patent application, entrance examinations, and student achievements except trade secrets for preventing unfair competition. In principle, these all should be managed with the idea that they are confidential and should not be disseminated to others. Trade secret management for a university is also part of the appropriate management for university's information.3. In general, the purpose of trade secret management is based on the following two points: (1) to protect one's own property, (2) to forbid some others persons to encroach on others' trade secrets. |
