本報告旨在討論托嬰中心、居家式托育服務場域之托育服務人員涉及虐待或不正當對待嬰幼兒事件的本相和性質。針對所蒐集之法學資料庫裁判書，衛福部裁罰公告，以及地方政府的行政裁罰書等文件，以文件分析法，進行定量及定性的分析。同時也通過焦點團體訪談及個案訪談策略，蒐集學者、專家、實務工作者及主管部門行政人員對於托育服務人員涉及虐待或不正當對待嬰幼兒有關的文本或語料，並採質性方法進行托育疏忽或虐待事故案例的脈絡分析。藉由自製的分析框架，我們綜合整理出托育照顧情境內直接、間接，以及托育照顧情境外影響疏忽或虐待事件發生的重要因素。本文依所蒐集資料分別敘說出三個部份的分析結果，包括疏忽情形與虐待事件的背景、影響因素，以及施虐手法及部位等。本文雖嘗試呈現托育疏忽或虐待事件案例的整體脈絡，但是各種因素其實環環相扣，互有關聯；故所呈現之結果，並非全貌，而是概略圖像，用以輔助系統思考，洞悉其間內情。

The purpose of this report is to discuss the truth and nature of incidents of abuse or mistreatment of infants and young children involving childcare providers in infant care centers and family childcare home. Quantitative and qualitative analysis was conducted using the document analysis method on the collected documents such as notice of judgments from the Judicial Yuan's Legal Database, penalty announcements of the Ministry of Health and Welfares, and local government's sanction letter. Meanwhile, we also used focus group interviews and case interview strategies to collect texts or corpus from scholars, experts, practitioners, and administrative department personnel related to the abuse or improper treatment of infants and young children by childcare providers. This part of data we adopted qualitative methods to conduct contextual analysis of cases of childcare neglect or abuse. Through a self-made analytical framework, we comprehensively sort out the important factors that affect the occurrence of neglect or abuse directly, indirectly, and outside the childcare context. Finally, we describe the analysis results in three parts based on the collected data, including the background and causes of neglect or abuse cases and various abusive methods or behaviors. In fact, various situations are interconnected and related to each other. Although this article attempts to present the overall context of cases of childcare neglect or abuse, the results presented are not a complete picture, but a schematic image to assist systematic thinking and gain insight into the internal situation of incidents.
