中國大陸的人事制度從源自蘇聯「黨政軍」的幹部制,透過公務員制度的改革,逐漸建構現代化國家的人事制度;而職位聘任制的改革,更是公務員制度改革的重點,也是行政革新首要之務,朝向現代化國家發展的實踐。中華人民共和國公務員法第十六章,對「職位聘任制」作出具體制度設計,期能解決公部門專技人才不足、用人缺乏彈性等弊端,並納入法制化的規範。在深圳市等地試行職位聘任制後,也逐漸顯現制度的問題與困境。本文就公務員法聘任制度之設計著手,以闡述其之於人事制度改革的意義,並指出部分公務員職位實施聘任制度,除了呼應各國人事制度改革的趨勢,亦是行政革新必經之路,除了確立公務員之專業化與法制化,亦可以實踐多元靈活之雇用政策。 |
英文摘要 |
The personnel system of Mainland China has its origin from the party cadre system of "Party, State and Military" from the former Soviet Union. Through the reform of its civil servants recruitment system, Mainland China is gradually exhibiting its development into the personnel systems of advanced nations. The reform of employment by function is indeed the gravity of the reform of the civil servants recruitment system and is the immediate concern for administrative reform, which will lead China to approach to the goal of a modern state. Chapter XVI of the "The Civil Servant Law of the People's Republic of China" provides the details of the employment of civil servants to relevant functional positions. This design aims as solving the problem of the inadequacy of human resources with strong professional standing and the lack of flexibility in recruitment. In addition, the recruitment process is institutionalized under law. The system has been tentatively introduced in Shenzhen as a pilot project. Related issues and problems surfaced as the system unfolded. This paper is an attempt to explore the meaning of the personnel system reform about "Civil Servant Law" in China through the background of the system and the result of the pilot project exemplified by the employment system of certain position of civil services. This is indeed the response to the trend of the personnel system of many countries of the works and the necessary path for administrative reform. The reform of the civil servant recruitment system helps to establish the criteria for the professional standing and legitimacy of personnel to the right positions and the pursuit of the employment policy with flexibility and diversity by the government. |
