警械使用條例之改進芻議

「執法過當」一詞儼然已成為，當今社會對於警察執法導致人民傷亡時，民眾對此行為給予的評價。綜觀警械使用條例之立法沿革，雖經歷5次修正，然而最近一次之修正日期為民國91年6月26日，距今已有19年之遙，鑒於法治意識抬頭、社會變遷快速，警察必須面對與處理的狀況與型態更為多元，現行法已多有不合行時宜之處，常無法符合民眾期望、與因應實務需求之缺憾。因此，本研究以警械使用條例內容為研究對象，包含警械種類之分類、使用時機之不確定法律概念運用等，加以探討並提出四個主要的修正建議。

The term ＂excessive law enforcement＂ seems to have become the evaluation given by the public to the police's law enforcement causing casualties to the people in today's society. Looking at the legislative evolution of the Regulations on the Use of Police Equipment, although it has undergone 5 revisions, the latest revision date was June 26, 1991, which has been 19 years away. In view of the rising awareness of the rule of law and the rapid social changes, the police must The situations and types of confrontation and handling are more diverse, and the current law has many shortcomings that are out of date, often unable to meet the expectations of the public and to meet practical needs. Therefore, this study takes the content of police equipment use regulations as the research object, including the classification of police equipment types, the application of uncertain legal concepts of use timing, etc., to discuss and propose four main revision suggestions.
