我國少年矯正政策從日治時期已具備規模。根據資料,日治時期台灣因應日本政府實施少年法,同時實施了「台灣總督府感化院規則」等少年矯正相關法規2,開啟了台灣少年矯正邁向現代體制之肇始。本文主要從二次戰後50年代至今,少年保護處分當中感化教育從感化院、輔育院、矯正學校之濫觴,以文獻回顧探討我國感化教育矯正學校改革之歷史脈絡,聚焦於矯正學校改制後司法少年出校學籍轉銜、離校追蹤與適性化學習等議題。其研究目的主要在於檢視感化教育當中矯正學校改制後前述學習適性化、學習轉銜與後續追蹤等狀況,並提出未來再次改革之建議。

英文摘要

Taiwan's juvenile corrections system has undergone much development since being officially established during the Japanese colonial era along with the necessary legal provisions. In this research I examine the related documents and discuss the various phases Taiwan's juvenile corrections system has gone through since the 1950s, from reformatories to correctional institutions to correctional schools, focusing on the transfer of juveniles out of the correctional school system, following up on them, and their ability to adapt to a new learning environment. The findings are expected to serve as a useful reference for carrying out additional restructuring in the future.
