自從師大性侵害案與中正大學性騷擾案揭發以來,已過近十個年頭。此期間,性騷擾事件成為社會矚目以及媒體追逐的焦點之一,相關的法案有了修改,校園裡成立兩性平等教育委員會,勞委會、台北市政府、台北縣勞工局、高雄市勞工局、 行政院所屬各部會等組識都相繼成立「性騷擾評議委員會」,性騷擾事件有了更多的申訴管道,這是台灣女性主義與女權運動者的重要成果之一。但是,性騷擾概念之法理化主要是源自西方菁英,近年來大力引進台灣社會,那麼,西方與本土遭逢之際,是否與本土社會文化脈絡中的相關概念有所衝撞或互補,它們又如何影響性騷擾事件的處理過程,這是本文主要的探討目的。 本論文藉著主要三個及其他發生在校園中的學生及教師同儕間的性騷擾案事件之調查與處理過程中,發生在受害者、加害者及調查員、相關處理人員等之語言敘說、心理及行為反應,層層揭露本土組織文化、社會結構及文化脈絡中攸關性別之刻板觀念、語言歧視、情慾自主、權力結構及思維模式等之特殊現象。希望藉著對本土文化中關於性別、組織、社會文化之深度反思,提供未來關於性騷擾之教育、懲處、立法及進一步研究等之參考。 |
英文摘要 |
It has been ten years since the disclosure of cases of sexual assault in National Taiwan Normal University and sexual harassment in National Chung Cheng University. In these ten years, sexual harassment cases have caught the attention of the media and public; laws and regulations related to sexual harassment have been revised; the Gender Equity Education Committee is established at various levels of educational institutions; in addition, the Sexual Harassment Adjudication Committee is also established at different levels of government. Many channels have been created to complain about sexual harassment. These are major achievement of feminist scholars and activists in Taiwan. However, the concept of sexual harassment originated from the West, so we would like to examine how it works in the local socio-cultural context, whether there are conflicts when western concepts are used in local Taiwanese society, and what we need to pay attention to when processing sexual harassment cases here. In this article, victims, suspects, and involved persons of the main three and other sexual harassment cases on campus were interviewed. We discuss the stigmatization of the victims, the cultural context of gender role cultivation, the misuse of feminism by men in sexual harassment issues, the prevalence of conspiracy explanations, the bureaucratic organizational culture, and the thinking of “The Doctrine of Mean” Taiwan. In conclusion, we provide implications for education, legislation, and investigation relevant to sexual harassment in Taiwan society. |
